Terms and Conditions
This Services Agreement (“Agreement”) is made as of the date (the “Effective Date”) signed by Customer
(“Customer”) and Bold Services Inc. D/B/A Bold Disposal (“Bold”), with offices located at 528 Prospect Street
East Orange, NJ 07017. The Customer and Bold are sometimes collectively referred to herein as the “Parties”
and individually as a “Party.”
Customer wishes to be provided with the Services (collectively the “Services” as defined below) by Bold and
the Bold agrees to provide the Services to the Customer in accordance with the terms and conditions of this
Agreement.
NOW, THEREFORE, in consideration of the mutual covenants and promises contained herein, and other good
and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, and intending to be
legally bound, the Parties agree as follows:
1. Services: Customer wishes to rent Dumpsters for collection and disposition of waste in compliance with all
laws, rules, and regulations applicable to such Services in New Jersey. By signing below, Customer agrees to
all terms and conditions of this Agreement, acknowledges and consents that these same terms and conditions
shall apply to all orders and business with Bold and that these terms and conditions shall remain in effect
irrespective of discussion or performance that may seem to conflict with the terms and conditions herein.
Further, Customer consents to have the credit card or payment method listed above billed for the cost of
Services, as well as any additional charges as described herein and any facility charges and/or violations that
Bold in its sole discretion believes to be due from Customer.
Customer acknowledges and agrees to the following rules regarding the Services. In each and every event Bold
shall have sole discretion as to whether to remove the Dumpster as filled and/or whether to assess additional
fees incurred by the Customer for infracting these rules.
2. Prohibited Materials: Customer may only fill the Dumpsters rented with materials that are permitted to be
removed and disposed of by Bold. Materials not allowed in Dumpsters include:
● Asbestos, Aerosol Cans, Biohazard or medical waste, Chemicals, Oils, Equipment with gas or oil,
Industrial Waste, Lead based waste, Paint, PCB's, Propane Tanks, Radioactive Material, Electronics,
TV, Railroad Ties, Computers, Stereos, Batteries, Contaminated soil, Fluorescent Lights, Tubes,
Liquid, Refrigerant Products (Freon), Tires, Pesticides, Herbicides, Mattresses, Box Springs.
● Appliances are taken with prior arrangement only.
● Concrete, Bricks, Asphalt, Clean Soil, Rock, Sand, Stone, or any dense material can be taken but
with prior arrangement.
● Mixed loads such as garbage and shingles, electronics and concrete, or construction debris and dirt
are not allowed in the Dumpster.
In the event that such items are found in the Bold Dumpster(s) before the Dumpster is picked up, Bold may
refuse to pick up the Dumpster and Customer will be billed for the time used in traveling to the site, the time
involved in making such assessment, and the time that the Dumpster remains unavailable for use and service to
others because it remains in use for the Customer subject to this Agreement.
In its sole discretion, Bold may choose to separate mixed loads for proper disposal for additional rates.
In the event that such items are found to be in the Bold Dumpster(s) after removal, Customer shall be
responsible for any extra costs incurred by Bold for legal disposal of such items.
Customer is responsible for the contents of each Dumpster in all instances. By way of example only, if a
third-party places material in the Dumpster while it is on Customer’s grounds and such materials result in
additional costs and fees, then Customer shall be and consents to being held responsible for such fees, costs,
violations etc.
3. Fees: There may be additional fees payable to Bold depending on circumstances. Examples include, but are
not limited to:
$250.00 per delivery Price per ton as per county
$750.00 per box up to 4 ton, overage will be per county fees
For each laborer, One Hundred Dollars $100.00 per hour billed in increments of 15 minutes.
For each hour beyond the pickup day and time that a Dumpster is unavailable for use in service of other
customers $10 per dumpster per day.
In the event that Bold arrives at a scheduled pickup and cannot complete the pickup in a timely manner due to
failure of Customer to comply with the rules herein, Bold will charge a Non-Pick fee of $200.00
Checks returned for insufficient funds will be charged a fee of $30 and cash will be required as a form of
payment.
4. Capacity: Customer acknowledges that each Dumpster has limited capacity in volume and weight and that
Customer is responsible for conformity with all such limits. Any costs, fees, violations, incurred due the failure
to adhere to the capacity limits shall be the responsibility of the Customer. Such limits include:
● Dumpsters can only be filled to the top of the rim. Material over the top of the rim is potentially
hazardous to Bold operators and other vehicles on the roadway. Some cities issue fines, and such fines
would be charged to the Customer’s account.
● Bold may not pick up a Dumpster if it is overloaded.
● Dumpsters have weight limits as specified.
● All Dumpsters are weighed at the disposal site. Loads over the estimated quote for weight limit are
assessed additional charges by weight and by county and any such additional charges will be the
responsibility of the Customer and will be charged to the customer account.
● Customer acknowledges that dense material will likely fill up to weight capacity before Dumpster
volume capacity is reached. By way of example only, items such as brick, concrete, clean soil, asphalt,
rock, sand and other heavy material may result in a space capacity while exceeding the weight capacity.
● Bold, in its sole discretion, may determine to not pick up a Dumpster if the driver determines it is
overweight by any transportation related laws and/or guidelines when they arrive at Customer’s site.
Customer will be billed for the time used in traveling to the site, the time involved in making such
assessment, and the time that the Dumpster remains unavailable for use and service to others because it
remains in use for the Customer subject to this agreement.
● In the event Bold receives an overweight violation while hauling Customer’s load, Customer will be
billed the full amount of the violation and a surcharge fee.
5. Dumpster Damage and Accessibility: Customer is responsible for any damage caused to the Dumpster while
it is in Customer’s possession. The Customer shall not make any alterations or improvements to any Dumpster.
The Dumpster must be accessible for pick-up by the Dumpster truck. Snow must be shoveled sufficiently to
allow safe access, and vehicles and debris kept clear. Bold will always schedule or call prior to pick-up and
placement so as not to inconvenience Customer. Upon arrival by Bold, Customer must have a parking space
available for the Dumpster and must ensure accessibility to same by the placement vehicles. Customer shall be
responsible for additional fees pursuant to the schedule contained in this Agreement for time Bold must wait for
such availability and accessibility.
6. Limitation of Responsibility. Cooperation and Claims. Customer hereby agrees that Bold is not responsible
for damage to driveways, lawns, sidewalk, curbs, other road surfaces or underground utilities in the path to the
Dumpster. Customer shall be solely responsible for the costs of and for the actions required to obtain any
required permits or waivers required by state, county or local municipality ordinances. NO ACTION SHALL
BE BROUGHT FOR ANY CLAIM RELATING TO OR ARISING OUT OF THIS AGREEMENT MORE
THAN ONE (1) YEAR AFTER THE ACCRUAL OF SUCH CAUSE OF ACTION, EXCEPT FOR MONEY
DUE ON AN OPEN ACCOUNT.
By Signing this Agreement, Customer acknowledges receipt of and a willingness to comply with the terms and
conditions herein and to have their credit card or other payment method billed accordingly. Dumpsters will not
be delivered without a signed Agreement and a valid credit card or payment method authorization on file.
By signing this form, Customer agrees to all rules and regulations guiding use and billing of these services, and
that without exception it is their responsibility to read and familiarize themselves with the terms of this
Agreement. Customer’s signature implies that they had read and agree to each term of the Agreement, and they
are responsible as such whether they have in fact familiarized themselves with the Agreement terms or not.

*Please Note! It's the customers' responsibility to ensure parking for the dumpster and that no car is blocking the spot. If the truck is not going to be able to drop or pick up the container when arriving on site, there will be a trip charge.
 
* No tires are allowed in the dumpster, In case any tires are found in the dumpster during routine inspections, there will be an additional charge of $50 per tire added to your invoice. 
 
*Our Company cannot be held responsible for any damages incurred to your driveway or pavement during the course of our work.
