Always Sunny On Main 24 Hour Access Policy
I, the undersigned, confirm that:
I have agreed to purchase a membership at a facility that allows me access at any time. As such, I am aware that there will be no supervision or assistance. I am also aware that if I am injured, become unconscious, suffer a stroke or heart attack, that there will likely be no one to respond to my emergency and this facility has no duty to provide assistance to me. Even though this facility is equipped with surveillance cameras, it is likely that should I require immediate assistance, none will be provided.
I acknowledge that parking on the street or in the city lot behind ALWAYS SUNNY ON MAIN between 2:00 AM and 6:00 AM I must obey the city ordinance that only allows for 30 minute parking. If I am parked for longer than 30 minutes I could be given a ticket. I acknowledge that the ticket is my responsibility, not ALWAYS SUNNY ON MAIN.
I acknowledge that I are not allowed to bring in guests while I tan during non-staffed hours. By bringing a guest I understand that my 24 hour access will be revoked.
I acknowledge that this waiver and release of liability includes, without limitation, all injuries which may occur, regardless of negligence, as a result of; (a) my use of all amenities and equipment in the facility, (b) the sudden and unforeseen malfunctioning of any equipment, and (c) your slipping and /or falling while on the premises, including adjacent sidewalks and parking areas.
I acknowledge that I have carefully read this “waiver and release” and fully understand that it is a release of liability. I expressly agree to release and discharge ALWAYS SUNNY ON MAIN, and all affiliates, employees, agents, representatives, successors, or assigns, from any and all claims or causes of action. I agree to voluntarily give up or waive any right that I may otherwise have to bring a legal action against ALWAYS SUNNY ON MAIN for negligence, personal injury or property damage.
Note: Should any part of this agreement be found by a court of law to be against public policy or in violation of any state statute or case precedence, then only that wording is removed and the remainder of this agreement will remain in full force.
