WAAC provides members use of facilities and discounts on programs. To remain a member in good standing dues and other charges must be paid on time. Payment can be mailed or left at 1024 Patterson Rd., 78733. Alternatively credit card or debit card payments using Google Check out can be made at www.wfly.com under Make a Payment. All members agree to be familiar with and follow all WAAC Rules. A copy of these rules is available at www.wfly.com.
WAAC members and participants in club sponsored classes may use WAAC equipment, however, adherence to WAAC rules concerning all equipment and facilities must be followed. Members are personally responsible for damage to or theft of equipment caused by their own negligence and carelessness. Class fees may be billed to members’ accounts and are due at the next billing period.
WEST AUSTIN ATHLETIC CLUB MEMBERSHIP APPLICATION
IN CONSIDERATION of being given the opportunity to participate in any WEST AUSTIN ATHLETIC CLUB (“Club”) activities (“Activity”)I, for myself, my personal representatives, assigns, heirs, and next of kin:
- ACKNOWLEDGE, agree and represent thatIunderstand the nature of the fitness Activities available at the Club, and thatIand my named family members are qualified, in good health, and in proper physical condition to participate in such Activity. Iunderstand that before undertaking any exercise program any participant should consult with their physician.
- FULLY UNDERSTAND that: (a) CLUB ACTIVITIESINVOLVE RISKS AND DANGERS of serious bodily injury, including permanent disability, paralysis and death (“Risks”); (b) these Risks and dangers may be caused by my own actions or inactions of others participating in the Activity, the condition in which the Activity takes place, or the negligence of the Releasees named below; (c) there may be other risks and social and economic losses either not known to me or not readily foreseeable at this time; andIFULLY ACCEPT AND ASSUME ALLSUCHRISKS AND ALLRESPONSIBILITY FORLOSSES, COSTS, AND DAMAGESIincur as a result of my participating in the Activity.
- AGREE to sign-in myself and guests each visit to WAAC and to follow and adhere to the rules of the Club and to have my family members and guests follow and adhere to those rules;
- AGREE AND WARRANT that I will examine and inspect each Activity in which I take part as a member of the Club and that, if I observe any condition which I consider to be unacceptably hazardous or dangerous, I will notify the proper authority in charge of the Activity and will refuse to take part in the Activity until the condition has been corrected to my satisfaction;
- AGREE to reimburse WAAC for any equipment loss for which I am responsible, or repair, to WAAC’s satisfaction, any equipment damage caused by my neglect.
- HEREBY RELEASE, discharge, and covenant not to sue the Club, their administrators, directors, agents, owners, members, volunteers and employees, other participating organizers, any sponsors, advertisers, and if applicable, owners and leasers of premises on which the Activity takes place, (each considered one of the Releasees alleged to be caused in whole or in party by the negligence of the Releasees of otherwise, including negligent rescue operations; and I further agree that if, despite this release and waiver of liability, assumption of risk, and indemnity agreement, I, or anyone on my behalf, makes a claim against any of the Releasees, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS each of the Releasees from any litigation expenses, attorney fees, loss, liability, damage, or cost which any may incur as a result of such claim.
I have read this agreement, fully understand its terms, understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid, that balance, notwithstanding, shall continue in full force and effect.
